RE: Landlord and Tenant Board Scheduling Update

We are pleased to share a new scheduling initiative that will begin on October 5, 2026.

As part of the Board’s broader strategy to improve service delivery and increase scheduling capacity, we are introducing a new approach to T6 Tenant Applications.

Beginning October 5, 2026, Dispute Resolution Officers (DROs) will conduct Case Management Hearings for T6 applications. During these proceedings, DROs will address applications that are withdrawn or abandoned, hear uncontested matters, and make reasonable efforts to resolve contested issues through mediation. Applications that remain unresolved will be adjourned and scheduled for a merits hearing before an Adjudicator.

Under section 206.1 of the Residential Tenancies Act, and section 1.7 of the LTB Rules of Procedure, DROs are designated Hearing Officers. They are authorized to conduct certain hearings and issue orders in prescribed circumstances, including matters where a party fails to attend or where the parties have consented to the terms of an order.

This initiative is intended to facilitate the timely and efficient resolution of matters within the DRO/Hearing Officer’s jurisdiction while ensuring procedural fairness and administrative efficiency.

Nous avons le plaisir d’annoncer que nous apportons des changements au processus d’inscription au rôle à compter du 5 octobre 2026.

Dans le cadre de la vaste stratégie de la Commission visant à améliorer la prestation de services et à augmenter la capacité d’inscription au rôle, nous adoptons une nouvelle approche pour le traitement des requêtes T6 des locataires.

À partir du 5 octobre 2026, les agents de règlement des différends tiendront des audiences de gestion des cas pour les requêtes T6. Durant ces audiences, les agents traiteront les requêtes retirées ou abandonnées et les requêtes non contestées et feront tout en leur pouvoir pour régler par la médiation les requêtes contestées. L’audience sera ajournée pour les requêtes qui n’auront pas été résolues et elles seront inscrites au rôle pour une audience basée sur le fond devant un arbitre.

En vertu de l’article 206.1 de la Loi de 2006 sur la location à usage d’habitation et de la règle 1.7 des Règles de procédure de la Commission, les agents de règlement des différends sont désignés agents d’audience. Ils sont autorisés à tenir certaines audiences et à rendre des ordonnances dans des circonstances bien définies, y compris dans les affaires où une partie omet de se présenter et celles où les parties consentent aux conditions de l’ordonnance.

RE: Bill 60 and Bill 97 Amendments to the Residential Tenancies Act, 2006 (Effective September 21, 2026)

Further to our memo on July 1, 2026, we are writing to inform you of several additional changes at the Landlord and Tenant Board (LTB) that will come into effect as of September 21, 2026. These changes reflect amendments to the Residential Tenancies Act, 2006 (RTA) introduced through the Fighting Delays, Building Faster Act, 2025 (Bill 60) and the Helping Homebuyers, Protecting Tenants Act, 2023 (Bill 97).

The following changes will take effect today, on September 21, 2026:

• Notice Requirements for N12 (Landlord’s Own Use Applications):
  For notices served on or after September 21, 2026, if the landlord gives at least 120 days’ notice to end a tenancy for personal use using an N12 Notice, they are no longer required to:

• Pay compensation to the tenant, or;

• Offer the tenant another acceptable unit
  

If the landlord provides less than 120 days’ notice, the existing compensation rules will apply. This change does not apply to N12 notices served for purchaser’s own use of the rental unit.

• Landlord Occupancy following Eviction for Landlord’s Own Use

Effective September 21, 2026, the landlord or another specified person (such as an immediate family member or their caregiver) must normally take occupancy within 60 days of the date specified in the N12 Notice to End Tenancy for Landlord’s Own Use.

If the Landlord or intended person does not take occupancy within this time frame, it may be presumed that the notice of termination was given in bad faith. The tenant may file a T5 Application: Landlord Gave Notice of Termination in Bad Faith.
This change does not apply to N12 notices served for a purchaser’s use of the property.

• Notice Requirements for N13 (Ending a Tenancy Early due to Repairs, Renovations or Demolition):

If a landlord files a N13 Notice of Termination to end a tenancy due to renovation and repairs, the tenant has the right has the right to move back into the rental unit once the work is done at a rent that is no more than what the landlord could have charged if there had been no interruption in the tenancy.

If the tenant provides written notice on or after September 21, 2026, that they intend to move back into the rental unit once the work is completed, the landlord must:

• Notify the tenant in writing of the estimated date the renovations or repairs will be finished, without delay

• If the estimated completion date changes, notify the tenant without delay

• Notify the tenant in writing when the work is completed and the rental unit is ready for occupancy.

The landlord must also provide the tenant with 60 days’ notice to reoccupy the unit following the completion of renovations if the work is completed on or after September 21, 2026.

• Remedies for Tenants (Right of First Refusal)

Under the existing rules, tenants may apply to the LTB using a T5 Application: Landlord Gave Notice of Termination in Bad Faith if they give written notice to their landlord that they want to move back into the rental unit after repairs or renovations are completed, and the landlord did not allow them to move in.

Effective September 21, 2026, the deadline for a tenant to file a T5 Application will change. The new deadline is two years after the date the tenant moves out, or within six months after the renovations are finished, whichever date is later.

Effective September 21, 2026, if a tenant gives written notice to their landlord that they want to move back into the rental unit after repairs or renovations are completed, and the landlord did not provide the required information about when the unit would be ready for occupancy or did not give the tenant 60 days to move in, it is presumed that the landlord failed to give the tenant a right of first refusal. The landlord has an opportunity at the hearing for the T5: Application to prove that the N12 Notice was not served in bad faith.

Applications for Non-Payment of Rent (N4)

• N4 (End Tenancy Early due to Non-Payment of Rent)

The notice period for an N4: Notice to End Tenancy Early due to Non-Payment of Rent is shortened from 14 to 7 days. A revised version of the notice form is now available on the Tribunals Ontario Portal and Website.

UPDATED: N4: Notice to End Your Tenancy Early Due to Non-Payment of Rent

• Tenant’s Ability to Raise Issues at a Hearing for Non-Payment of Rent

In order to raise other issues at a hearing for non-payment of rent (such as maintenance or Tenant’s Rights concerns), the tenant must pay the landlord half of the rent arrears claimed in the landlord’s application at least seven days before the hearing.

This applies if the landlord filed the rent arrears application on or after September 21, 2026.

Payment must be made directly to the landlord. It cannot be paid to the LTB in trust. Tenants should keep a receipt as proof of payment.

The existing requirement that the tenant provide the landlord and the LTB with a description of all the issues they want raise at least seven days before the rent arrears hearing continues to apply.

UPDATED: Issues a Tenant can Raise at a Hearing about a Landlord’s application for Non-Payment of Rent (Form)

• Persistent Late Payment of Rent

As of September 21, 2026, a tenant is considered to have persistently failed to pay rent on the date it becomes due when the rent is received more than seven days after the due date, at least three times within a six-month period.

However, if the only reason the payment is late is the landlord applied the tenant’s rent payment to another amount the tenant owed, such as rent arrears from an earlier period or unpaid utility charges, it is not considered late for this purpose.

A tenant may also be found to have persistently failed to pay their rent on the date it became due in other circumstances.

• Circumstances to Set Aside (or cancel) an LTB Eviction Order
  Effective September 21, 2026, the LTB may grant a tenant’s motion to cancel an eviction order that was based on an agreement between a landlord and tenant to end the tenancy, or on a notice given by the tenant to end the tenancy, only if the LTB is satisfied that doing so would not be unfair.
  
  The LTB cannot consider changes in the tenant’s circumstances that occurred after the agreement was made or after the tenant gave notice to end the tenancy.

• Circumstances to Delay an LTB Eviction Order

Effective September 21, 2026, if the hearing is held to consider a landlord’s eviction application the LTB may only order that an eviction be delayed if certain conditions are met.

If the landlord agrees, the LTB may delay the eviction.

If the Landlord does not agree, the LTB must be satisfied that:

• It would not be unfair to the landlord or other tenants in the residential complex to delay the order

• There are compelling reasons to delay the order

For notices of termination for landlord or purchaser’s own use and renovation or repairs, the LTB must only be satisfied that a delay would not be unfair to the landlord or other tenants in the residential complex.

LTB’s Updated Rules of Procedure

The LTB’s Rules of Procedure have been updated to improve clarity and formatting, reflect recent legislative amendments, and align with current practices.

Effective September 21, 2026, the following forms have been updated and replaced on the Tribunals Ontario Portal and website. The old version of these forms will no longer be accepted as of November 30, 2026.

· N5: Notice to End Your Tenancy for Interfering with Others, Damage, or Overcrowding

· N6: Notice to End Your Tenancy for Illegal Acts or Misrepresenting Income in a Rent-Geared-to-Income Rental Unit.

· N8: Notice to End your Tenancy at the End of the Term

· N12: Notice to End your Tenancy Because the Landlord, a Purchaser, or a Family Member Requires the Rental Unit

· N13: Notice to End your Tenancy Because the Landlord Wants to Demolish the Rental Unit, Repair it, or Convert it to Another Use

· L1: Application to evict a tenant for non-payment of rent and to collect rent the tenant owes

· L2: Application to End a Tenancy and Evict a Tenant or Collect Money

· L9: Application to Collect Rent the Tenant Owes

· L10: Application to Collect Money a Former Tenant Owes

She has worked extensively with landlords in urban, suburban, and rural communities, offering one-on-one assistance and practical guidance on issues such as Landlord and Tenant Board processes, compliance with provincial housing legislation, and policy impacts affecting small ownership housing.

“Small landlords provide a substantial portion of Ontario’s rental housing supply, yet they often lack the resources of large corporate operators,” said a spokesperson for SOLO. “Rose Marie has consistently demonstrated a deep understanding of these challenges and a strong commitment to ensuring small landlords have a clear and credible voice in provincial policy discussions.”

As President, Ms. Rose will lead the Board at a time when rental housing affordability, supply, and regulatory reform remain central issues at the Ontario Legislature. SOLO regularly engages with Members of Provincial Parliament, ministries, and stakeholders on legislation and regulations affecting rental housing providers across the province.

The organization also acknowledged the contributions of outgoing President Kevin Costain, whose tenure helped strengthen SOLO’s advocacy presence at Queen’s Park and expand its engagement with landlords throughout Ontario.

Here’s What’s Happening Now

Every day, your constituents face hardship and injustices within the residential housing system in Ontario. Their stories highlight the urgent need for reform and targeted solutions to protect Ontario tenants and landlords alike.

Evicted tenants in Richmond Hill caused $300,000 in damage before moving out, then filing for bankruptcy

Kathy Liu, a single mother, rented her sole investment property to tenants who fell behind in rent payments from Nov. 2023, and stopped paying rent in Mar. 2024. She filed with the LTB and after over a year, she received an eviction order for Feb. 2025.

On the day before eviction, the tenants emailed a video stating the house had been flooded. Kathy was shocked to discover the home had suffered catastrophic water damage, from the second floor down to the basement. She immediately hired a plumber and contacted her insurance.

Further investigation showed the tenants had cancelled the electricity and moved out since October 2024, and the video had been taken in January 2025. The water damage resulted in over $300,000 in estimated losses, and full reconstruction is ongoing, claimed from her own insurance.

The tenants had withheld mail, misled the LTB court, and pretended they still occupied the home. They changed their surname and filed for bankruptcy making it impossible for Kathy to recoup any costs. She also visited the York Region police who said her case was a civil issue.

Kathy has personally suffered extreme mental and financial stress, covering emergency repairs, child care costs, unpaid utilities, and missed rental payments of over $80,000.

Kathy says: “I have experienced severe emotional trauma, stress, and sleep loss, and this has also affected my physical health.”

Etobicoke resident and accidental landlord still waiting to evict tenants with over $31,000 in arrears

Sadaf S., a small business owner in Etobicoke, decided to earn extra income by renting the ground-level suite of her home on Airbnb. What started as a one-day stay in Jul. 2024 became months when her tenants refused to leave, and the police wouldn’t remove them.

In Dec. 2024, the tenants stopped paying the full rent, but as they had not signed a lease, there was nothing Sadaf could legally do. Finally, in May 2025, the situation was formally recognized as a tenancy by the LTB and Sadaf was able to file for an eviction for non-payment of rent in Jun. 2025.

The hearing took place in Sep. 2025. While the adjudicator acknowledged the arrears, the hearing was adjourned due to other matters filed by the tenants.

Through all this, the tenants harassed her, changed locks, installed cameras without permission, and denied Sadaf entry to the property. They also filed 4,000 pages of evidence against her, including documents manipulated by AI.

Sadaf says, “I’ve never experienced anything like this in my life. How can people who don’t pay rent for almost a year be allowed to stay? I’m not a large corporation. I’m just a regular person who is now under serious financial, emotional and mental stress. Please help.”

Niagara-on-the-Lake tenants over $25,000 in arrears after almost one full year of not paying rent

In 2021, St. Catherines resident, Saqib Khattak, rented his Niagara-on-the-Lake property to low income tenants and their four children at $400 below market rate.

In Jan. 2025, the tenants decided to stop paying rent, accumulating over $25,000 in arrears for rent and utilities. Despite offering a payment plan, Saqib received no response and filed an N4 eviction for non-payment of rent. However, he made a small error in the application and had to start over.

Saqib also filed an eviction for persistently late payment of rent, but this was dismissed by the LTB because he had an N4 filed.

Finally, a hearing on Sep. 9 resulted in an eviction date on Nov. 3., but with wait times for the Sheriff, the tenants will have lived without paying rent in his property for almost one full year.

Saqib says: “It’s heart-breaking. I did my best to help a family in need and even gave them $1,500 to pay for food over the years. Now I’m in debt and need to wait one year to get back my home. Is this fair to small landlords like me?”

A Call to Action

Over the past five years, Small Ownership Landlords of Ontario (SOLO) has been supporting our more than 8,500 small-scale housing providers—our members—to navigate the residential housing system in Ontario.

Since 2020, we have seen the residential housing system break-down, with long delays at the Landlord and Tenant Board (LTB) creating the rise of “professional tenants” and related online groups, creating an unfair system for small landlords—all of whom are small business owners—who provide over 30% of rental housing in Ontario.

The Landlord and Tenant Board (LTB) has a backlog of 53,000 cases according to the latest LTB report. 60% of LTB cases are regarding rental arrears.

We are calling for your support to streamline the process for uncontested cases of non-payment of rent. Specifically, we propose handling these cases administratively, without requiring a full hearing—similar to systems already in place in British Columbia, New Brunswick, Quebec, and Saskatchewan. This would significantly reduce the backlog at the LTB, and contribute to a fairer residential housing system for tenants and landlords in Ontario.
